How it works for a startup.

Selling to K-12 schools means working with FERPA, COPPA for children under 13 and a growing number of state student privacy laws. Districts often require a signed data privacy agreement before use. Investors and acquirers check that each customer has the right agreement and that data practices match it.

Revenue patterns differ by market. K-12 sales follow budget cycles and often depend on grant funding that can end. Higher education deals involve procurement and accessibility reviews. Consumer and workforce learning look more like subscription businesses, with cohort retention and completion rates.

Accessibility is a standard requirement. Public institutions often ask for a VPAT and conformance with WCAG, and gaps can block renewals.

Set up the room in 6 steps.

  1. 1

    Map privacy agreements

List each customer with the data privacy agreement signed and the state law that applies.

  2. 2

    Show where money comes from

Separate revenue funded by temporary grants from recurring budgets.

  3. 3

    Back outcome claims

Link each efficacy claim to a study and its method.

  4. 4

    Collect accessibility reports

File the current VPAT and any audit with the remediation status.

  5. 5

    Redact student data

Never upload student records. Redact names from any sample reports.

  6. 6

    Plan for seasonality

Explain the bookings calendar so reviewers read quarterly swings correctly.

Common mistakes.

  • Students' personal data in sample reports shared with investors.
  • Districts using the product without a signed data privacy agreement.
  • Revenue that depends on expiring grant programs presented as recurring.
  • Accessibility gaps that block public sector renewals.

Questions founders ask

What is FERPA?
A federal law that protects the privacy of student education records at schools that receive federal funding. Edtech vendors often handle such records on behalf of schools.
What is a data privacy agreement in edtech?
A contract between a school or district and a vendor that sets how student data may be used and protected. Many states have standard versions.
Why is K-12 revenue seasonal?
Schools buy on annual budget cycles, so bookings cluster around certain months, often before the new school year.
